Firearm means any weapon which will, is designed to, or may readily be converted to expel a projectile by the action of an explosive, the frame or receiver of any such weapon, any firearm muffler or firearm silencer; any destructive device; or any machine gun. The term firearm does not include an antique firearm unless the antique firearm is used in the commission of a crime.

There are several weapon offenses that an individual may be accused of in Florida, these can have the potential to be felonies and convictions can result in long-term imprisonment and an individual may also have to pay vast fines.

Some firearm charges can include:

  • Carrying a concealed firearm
  • Armed robbery
  • Armed burglary
  • Illegal possession of a firearm
  • Felon in possession of a firearm
  • Selling and delivering firearms
  • Manufacturing firearms or other weapons
  • Firing into an occupied dwelling or vehicle
  • Brandishing a firearm
  • Discharging a firearm in public
  • Using a firearm while under the influence
  • Aggravated assault with a firearm
  • Improper exhibition of a firearm
  • Possession of ammunition during the a felony
  • Commission of any felony with a firearm
  • Violation of a restraining order

If you are caught performing any of the above actions while already under something such as probation, the court can apply sentence enhancements or even cancel your probation all together. It is critical to investigate charges and the weapon and prepare the case with care.

Possessing a firearm is considered a severe offense, and using a deadly weapon in a crime is able to turn a misdemeanor into a felony that may result in harsh penalties in court if you are convicted.
